These Terms of Usage are between you and Syncpoly OÜ, the company that provides WittyTalk.

Using WittyTalk

WittyTalk provides interactive learning, practice, and feedback tools for communication, sales, negotiation, investor pitching, objection handling, and related skills. You may use WittyTalk only for lawful purposes and in a way that does not interfere with the service or other users.

You are responsible for keeping your account credentials secure and for the activity that happens through your account.

Accounts and eligibility

You must provide accurate account information and keep it up to date. If you use WittyTalk on behalf of an organization, you confirm that you have authority to accept these terms for that organization.

WittyTalk is not intended for children who are not old enough to use online services under the laws that apply to them.

Learning content, AI, and feedback

WittyTalk may provide prompts, examples, AI-generated feedback, voice responses, scores, achievements, offers, and progress recommendations. These materials are for learning and practice only. They are not professional, legal, financial, investment, employment, or business advice.

You remain responsible for decisions you make based on your use of WittyTalk.

AI and voice features may be wrong, incomplete, delayed, or unavailable. Do not submit confidential, sensitive, regulated, or third-party information unless you have the right to use it and you are comfortable with it being processed for the feature.

Subscriptions, purchases, and entitlements

Some WittyTalk features may require a paid plan, product, subscription, or entitlement. Plan details, pricing, renewal terms, and included features are shown at checkout or in the billing area.

If a plan includes energy, unlimited energy, premium access, or another entitlement, access is granted only while your account remains eligible for that entitlement. Syncpoly OÜ may update plan names, pricing, or included features for future purchases, subject to applicable law.

Payments are processed by third-party payment providers such as Stripe. Syncpoly OÜ does not store full card numbers.

Acceptable use

You must not misuse WittyTalk. This includes attempts to reverse engineer the service, bypass access controls, scrape content at scale, upload harmful code, abuse payment or account systems, impersonate others, or use the service to create unlawful, discriminatory, deceptive, or harmful content.

Your content

You may submit text, voice, answers, preferences, and other content while using WittyTalk. You keep ownership of your content, but you allow Syncpoly OÜ to use it as needed to operate, secure, improve, and provide WittyTalk, including creating transcripts, feedback, scores, practice history, and support/debug records.

Do not submit content you do not have the right to use.

WittyTalk content and intellectual property

WittyTalk, including its lessons, interfaces, design, software, branding, and learning materials, is owned by Syncpoly OÜ or its licensors. These terms do not transfer ownership of WittyTalk or its content to you.

You may not copy, resell, redistribute, or create competing datasets from WittyTalk content unless Syncpoly OÜ gives written permission.

Availability and changes

Syncpoly OÜ may update, suspend, or discontinue parts of WittyTalk to improve the product, maintain security, comply with law, or manage business needs. We try to avoid unnecessary disruption, but WittyTalk is provided without a guarantee that every feature will always be available.

Termination

You may stop using WittyTalk at any time. Syncpoly OÜ may suspend or terminate access if you breach these terms, create risk for the service or other users, fail to pay amounts owed, or use WittyTalk unlawfully.

Disclaimers and limitation of liability

WittyTalk is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, Syncpoly OÜ disclaims warranties that are not expressly stated in these terms.

To the maximum extent allowed by law, Syncpoly OÜ will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

Nothing in these terms limits rights that cannot be limited under applicable law.

Governing law

These terms are governed by the laws applicable to Syncpoly OÜ, unless mandatory consumer protection rules in your country require otherwise.
